Where can a guardianship petition be filed?

Do you want to file in the Hillsborough court location? Even though the town of Hillsborough is situated in Hillsborough County, the Hillsborough court is listed as a location in this program under 6th Circuit-Merrimack County (because the court used to be located in the town of Henniker).  You must select 6th Circuit - Merrimack County in the Where to File option above in order to then be able to select Family Division-Hillsborough later in the program.

Pursuant to RSA 464-A:3, the petition can be filed –

1) In the county where the proposed ward resides; or

2) In the county where the proposed ward is physically present when the proceedings are commenced; or

3) In the county where the proposed ward is admitted to an institution pursuant to a court order, or in which the ward has lived for a year or more; or

4) If the guardianship is for an estate and real property of the ward is involved, in the county where the real property is located.

Pursuant to RSA 463:4, the petition can be filed –

1) In the county where the minor resides; or

2) In the county where the minor is physically present when the proceedings are commenced;

3) In the county in which the authorized agency is providing services to the minor;

4) In the county in which the underlying cause of action arose;

5) In Guardianship of minor person only, the petition must be filed in the family division venue per RSA 490-D.
