You have two options for filing small claims (court form SC-50):

1. e-FILING: You can electronically file your statement of claim and pay court fees (free registration required ยน).

2. IN PERSON OR BY MAIL: You can print your statement of claim at any time and then mail or bring them to the New York Small Claims Court.

WHAT ARE THE JURISDICTIONAL REQUIREMENTS FOR FILING IN NEW YORK CITY?

Initial Claims:
A case may be filed in the Small Claims Part of the New York City Civil Court ONLY if the defendant resides, works, or has a place of business within New York City.

Counterclaims:
If you are filing a counterclaim, the counterclaimant (the original defendant) must have his or her residential address within New York City.

WHICH COURT SHOULD I SELECT?

You may file your small claim in the Small Claims Part of the New York City Civil Court located in either of:
 a) the county where you reside
 b) the county where the defendant resides, or works, or has a place of business

WHICH COURT LOCATION SHOULD I SELECT?

If the court you selected is Manhattan, you can select either of the two locations in the Select Location dropdown list.
